COMMITTEE ON PUBLIC WORKS

ALSO PRESENT:  Susan Gerry (Law);  Bill Randolph (CE’s ofc.).

 

 

DISCUSSION:

 

The meeting was called to order by Chair Pinto at 4:12 p.m., and began with a review of last week’s agenda items.  The discussion focused on the cemetery application for Union Church in Pocantico Hills.

 

Susan Gerry distributed a legal opinion noting that the State Law which, requires the CountyBoard of Legislators to approve all applications for cemetery land use in the County, was adopted as an exercise of the State’s police power in order to safeguard the health and property rights of landowners in the more heavily populated and developed counties.  It was also noted that the County cannot adopt a local law to amend the current Resolution (#206-1987) without a 6-week public notice period providing adequate notice of a proposed cemetery land use to its neighboring landowners, as required by NY State Law.

 

Legislator Wishnie questioned if the rules could be amended, and to charge the fees to the applicant for the six consecutive public notices.  Ms. Gerry responded that the County would have to draft legislation to amend the current State Law, and she would research this option and report her findings to the Committee at a later date.

Committee Blueprints were reviewed next, and an updated draft will be prepared for the next meeting.  The minutes of January 29th were reviewed and approved on the motion of Legislator Wishnie, seconded by Legislator Ryan, and carried 3-0.

 

With no further business to discuss, the meeting adjourned at 4:45 p.m., on the motion of Legislator Wishnie, seconded by Legislator Hall.
