COMMITTEE ON PUBLIC WORKS

MONDAY, JUNE 3, 1996

PRESENT: Co-Chair: Wishnie. Members: Carsky, Darcy, Latimer, Delfino. Staff: John Egner, DPW; Emilia Vita, Secretary.

 

ALSO PRESENT: Jamie Hastings, Director of Government Relations; George Hosey, Chairman, CBAC; Barbara Strauss, League of Women Voters.

 

 

The meeting was called to order at 2 p.m., the minutes of May 29th were approved and moved on the motion of Legislator Darcy, seconded by Legislator Latimer [4-0] {Delfino out for vote}.

 

Legislator Wishnie referred to the draft local law submitted by Tom Rothman, Bond Counsel to the Westchester Municipal Officials Association, Robert Meehan, President of the Association, is in receipt of the same letter. The same letter has been forwarded to the County Attorney for a legal opinion and to the County Executive for consideration.

 

Mr. Wishnie reviewed the letter which indicates flexibility to the County and municipalities utilizing the county’s trunk sewer systems. It permits an IMA to be tailored to the needs, as they may change from time to time, as determined by the County and municipalities. The proposed law reconstructs the tributary sewer systems of municipalities undertaken in accordance with direction from the Commissioner of Environmental Facilities to insure compliance with Federal or State Law, regulations or permits governing the operations of a facility that serves a community.

 

Mr. Rothman states in the letter this law will eliminate legal objections by the County’s counsel, and is, willing to make further provisions as necessary. He hopes with this proposal the Board, Counsel and the Administration will come to a determination...to meet the worthy goal of achieving significant savings to the properties and users within the affected municipalities.

 

Mr. Wishnie said he wants to proceed as soon as possible to provide enough time to react to any repercussion during the process.

 

Ms. Hastings suggests the Committee wait for the opinion of the County Attorney.

 

After brief discussion, the members agreed to continue discussions with the County Attorney at the next meeting.

ITEMS A and F: Both refer to County Water District #2 in the Town of Somers; Request to prepare necessary legislation was forward on March 18, 1996. [Items remain on the agenda]

 

ITEM B: Amendments to the Rules and Procedures of the Prequalification Selection Board and Reforms of the A & C Board. [Pending additional language requiring audit reporting from the County Attorney].

 

ITEM C: Merger of the Departments of Public Works and Environmental Facilities; Jamie Hastings asked the Chair to withdraw the item as requested by the Administration. Item is removed from the agenda by Co-Chairman Wishnie, moved by Legislator Delfino, seconded by Legislator Latimer [5-0].

 

ITEMS D, G, J, L: Financing of the Infiltration and Inflow Program. Items are received and filed on the motion of Legislator Delfino, seconded by Legislator Latimer [5-0].

 

ITEM E: Extension of Peekskill Sanitary Sewer District to include Somers Sewer District #1: [Along with the new referral of today’s Board meeting, will be forwarded to the Administration for necessary legislation].

 

ITEM I: IBM property to be used for Solid Waste Management. Item is received and filed on the motion of Legislator Latimer, seconded by Legislator Darcy [5-0].

 

ITEM K: Removing and adding properties to the Peekskill Sanitary Sewer District. Item moved to be received and filed by Legislator Carsky, seconded by Legislator Latimer [5-0].

 

 

 

 

 

 

With no further business to discuss, the meeting adjourned at 2:45 p.m. on the motion of Legislator Darcy, seconded by Legislator Latimer.
