The meeting was called to order at 1:45 p.m. The minutes of April 22nd were moved and approved on the motion of Legislator Swanson, seconded on Legislator Carsky [4-0] (Latimer, Delfino, Darcy out for vote). The minutes of April 15th with Environment will be held until further review.

 

Legislator Wishnie gave a brief summary of the inflow and infiltration process and the local and county responsibility. Initially, responsibility would fall on local communities and additional taxes will occur.

This Committee will try to do what is right and what direction to follow, the local municipalities and the Administration will try to work together to resolve this issue.

 

Board Chairman Oros said the Board approved and passed a resolution for an additional extension of June 30, 1996 in order to give additional time for the locals and the Administration to make a decision.

 

Eileen Pilla (Mayor, Tarrytown), President of the Municipal Officials Association, introduced the sub committee members, who, prepared an analysis on the proposed sewer improvements.

 

Ms. Pilla summarized the letter to the Committee (on file) which states how the county entered into consent orders with the NYSDEC for the reduction of inflow and infiltration. Since the local municipalities were not involved in negotiations, but are now mandated by the County to reduce the inflow and infiltration, the Association has reviewed the financial impact of this mandate and will present its analysis today.

 

Donald Marra (Mayor, Dobbs Ferry), Chairman of the Sub-Committee, stated that the Committee was formed about a year and a half ago, introducing its members, he noted reports of work sessions, reports to the Executive Committee, all positions were put on paper, the objectives, since, have not changed. The impact of financial cost effectiveness is as per mandate will benefit taxpayers. The Sub-Committee has met with the Administration’s staff and was told they would like to help, in the meanwhile, the Association retained legal counsel, who gave an opinion, which was sent to the Administration. The opinion stated the County could borrow money from municipal bonds to do the work, Mr. Marra feels there is no legal obstacle.

 

John Pierpont presented three basic premises to achieve I and I goals; operating cost reduction estimates; debt services estimates for each municipality, and effect on new debt services on municipal budgets. Mr. Fiaella presented the various sewer district models with the difference of financial improvements, the old and new district rates and the difference of the average district assessment and the average district change.

 

The difference shows the municipality cost at $32 million opposed to the County’s cost to do the work at $27 million.

Neil DeLuca had some disagreements, he believed it is not presently legal to do this work according to bond counsel, who thinks this can not be done. Mr. DeLuca feels non-for-profit organizations will be a problem, the consequence will be added taxes, which the County is trying to avoid. He feels the process is a problem, the set of numbers presented today is based on assumption, they need to be sure the numbers are right. Bond Counsel will not approve of any bond, lateral trunk lines are not legal. The County is in violation of the consent decree and will end up paying fines. Shifting the responsibility to the county will require change in State law, which means more extensions and he does not feel the DEC will grant any more.

 

A questions and answer period took place between the Committee members and the officials present and the Administration staff.

 

Co-Chair Swanson and Wishnie thanked Ms. Pilla, Mr. Marra and their associates for this presentation and asked that within the present extension time, all can agree upon the most fairest way to resolve this problem.

 

Mr. DeLuca said he will work with the Association and agree to meet with them in order to take advantage of this time to resolve the issue at hand and review the numbers presented.

 

 

 

 

 

With no further business to discuss, the meeting adjourned at 3 p.m. on the motion of Legislator Latimer, seconded by Legislator Carsky.
