*MINUTES COMMITTEE ON PUBLIC SAFETY & CRIMINAL JUSTICE MONDAY, JUNE 29, 1998 9:00 A.M.
PRESENT: Chair: Ryan. Members: Latimer, Kaplowitz, Mosiello, and Swanson. Staff: Hoch, Dodds, and Vita. ALSO PRESENT: George Hosey, Chair-CBAC. The meeting was called to order at 9:05 a.m. by Mr. Ryan. Mr. Ryan asked the members to advise him of their vacation schedules so that a summer schedule of Committee meetings can be arranged. Mr. Ryan provided the members with the proposed Omnibus Youth Crime Prevention Law and asked them to review the legislation, particularly with regard to the language dealing with restrictions on the sale of spray paint. Mr. Mosiello stated he had a problem with the legislation as it places spray paints, laser pointing devices, and the existing box cutter law in the same bill. He views the box cutter as a lethal weapon. Misuse of the box cutter constitutes a criminal offense in some cases. He feels the box cutter should be treated more seriously than the other two items and he would prefer to keep the box cutter law separate from any new law dealing with laser pointers and spray paints. He supports the Omnibus bill amended to exclude box cutters. Mrs. Carsky asked about the criminal codes and Mr. Mosiello explained that the State Penal Law defines what are dangerous instruments and covers anyone 16 years and older. Mrs. Swanson said the proposed Youth Crime Prevention Law improves the organization of County law by grouping measures meant to curb certain offenses by minors. Mr. Mosiello emphasized that box cutters are weapons that can be deadly.

He sees lasers and spray paint cans as items used primarily for mischievous behavior.
Mrs. Swanson stated that the proposed law would not be any less effective in curbing youth crime simply because it covered the prohibition of sale to minors for all three of these items. She felt that grouping the three items together in the law made sense. Mr. Kaplowitz said that provisions dealing with box cutters are a critical piece of the law, however, the Committee has an opportunity to strengthen the law by putting in one place all three items that should not be sold to youth. Mr. Kaplowitz agreed with removing from the proposed new "youth crime prevention" chapter the section of current law dealing with the sale of propane. Mr. Ryan stated that the proposal is a good one. This is an improvement to the organization of our County law. Such common denominators as the concern for the misuse of the items, the prohibition of sale to minors, the regulation of display, fines and penalties for sale to minors, all supports the idea of grouping the laser pointers, box cutters, and spray paint in one chapter of the law where the prohibitions and restrictions and the penalties can be easily found by the public. Mr. Ryan asked the members to continue to give thought to this proposal and to offer any ideas or suggestions to improve the bill prior to the Committee meeting on July 20. He will ask the Committee to report the proposed law to the full Board at that time. On the motion of Legislator Kaplowitz, seconded by Legislator Swanson the meeting adjourned at 9:55 a.m. |
