The meeting was called to order at 12:35 p.m.

 

MINUTES

Legislator Pinto made a motion to approve the minutes of October 28, 2002 (joint w/ LEG) and was seconded by Legislator Alvarado.  The vote was 4-0.  (Leg. Bronz was out for the vote.)

 

Item #28 – Stokes-Green Property

This property was purchased back in 1991 for general municipal purposes.  It consisted of approximately 120 acres and 100 of the acres were subsequently committed to park use and added to Croton Gorge Park.  The remaining acreage has been subdivided into two parcels and two lots.  The parcel to be sold is approximately 10 acres and the City of New York has agreed to pay the County $524,391.  It will be owned by the NYC Department of Environmental Protection and preserved as open space to protect the nearby Reservoir and water supply.  The County has no current future need for this property.  The estate complex, set on 8 acres is being put up for sale.  The remaining two parcels (total 1.4 acres) will be added to the adjacent Croton Gorge Park.

 

Legislator Pinto made a motion to sign out Item #28 for all purposes and was seconded by Legislator Alvarado.  The vote was 4-0.  (Leg. Bronz was out for the vote.)

 

Item #42 – Land Conveyance/Militello Restaurant

When the County purchased the Putnam Right-of-Way back in 1991 portions were already in use by adjacent commercial and non-commercial entities for which there were existing lease and license agreements.  Militello Restaurant d/b/a Tony’s LaStazione Restaurant in Elmsford occupied a small portion (approx. 4, 090 sq. ft.) of the PROW prior to the

County’s ownership.  That small portion includes the restaurant’s kitchen, garbage area and a small parking area.  Representatives for the

 

Restaurant proposed to purchase the portion of the PROW from the County for the continued and legal operation of their business.  An independent appraisal was done and because the parcel is landlocked the appraiser discounted the price by about 80%.  Due to the limited access to the property, the County and Restaurant representatives negotiated a sale price of $37,500.00.  This portion is not needed for the safe and continued operation of the South County Trailway or any other County purpose.

 

Legislator Abinanti expressed his concerns of this proposed Act raising issues such as an extremely low sale price and an appraisal that was 5-6 years old.  There was a lengthy discussion

 

Legislator Bronz made a motion to sign out Item #42 for all purposes and was seconded by Legislator Alvarado.  The vote was 5-0.

 

Subfolders

Legislator Pinto made a motion to create the following subfolders and receive and file the subsequent items into those folders and it was seconded by Legislator Alvarado.  The vote was 5-0.

Recv’d & Filed

Legislator Alvarado made a motion to receive and file Items #19 (White Plains Property Purchase), #21 (Macy Park) and #31 (Macy Park Footbridge) and it was seconded by Legislator Pinto.  The vote was 5-0.
