COMMITTEE ON COUNTY OFFICERS AND DEPARTMENTS MINUTES JULY 7, 1997 9:00 A.M.

Chairman Delfino called the meeting to order at 9:18 a.m.
On motion of Legislator Spreckman and seconded by Legislator Swanson the minutes of June 30, 1997 were approved by a vote of 5-0.
Discussion: There is a tape on file for more detailed information.
Code of Ethics: Chairman Delfino began the meeting by explaining that the County Attorney ruled that there are three issues that she feels need to go to referendum.
Mr. Vitagliano stated that he will be meeting with Stacey Kmetz tomorrow morning to go over the County Attorneys comments on the eighth draft of the Code of Ethics. Mr. Vitagliano then distributed to the Committee a draft of the three items to go to referendum. It shows each item as it is currently and what they propose it be changed to. He explained that the first item allows for the list of individuals required to file financial disclosure forms be reviewed annually by the appointing authority rather than only when a technical change is required, as is the current procedure. The second item would change the current waiver process. Instead of a departing employee receiving approval from the Board of Legislators for any potentially conflicting employment, the Board of Ethics would be empowered to act. The third item takes from the Board of Legislators the power to approve the hiring of former employees as consultants (within one year after termination) and gives it to the Board of Ethics. Mr. Vitagliano stated that whenever you take power away from an elected official a mandatory referendum is required.
There was a discussion on the wording of the items and how they would go to referendum, as well as whether the Board should change the items or leave the distribution of power as it is.
Patricia Gorski went over the calendar explaining when they could possibly have a public hearing, and a special meeting. She needs twenty-four hours notice to inform the press. Everything has to be done by August 5, 1997.
Mr. Vitagliano would like the County Attorney to review the list of changes to put them in the proper form for approval by the Board in order to allow a referendum to be on the ballot this November.
Legislator Swanson motioned to proceed with the County Attorney and was seconded by Chairman Delfino. The motion was carried by a vote of 5-0.
Mr. Vitagliano stated that after tomorrows meeting they will be able to set up a time table on how they will produced.
Legislator Swanson motioned to close the meeting at 9:54 a.m. and was seconded by Legislator Young. The motion was carried by a vote of 5-0. |
