Legislator Spreckman motioned to approve the minutes of September 29, 1997 and was seconded by Legislator Swanson. The motion was carried by a vote of 5-0.

TAXI & LIMOUSINE COMMISSION

Barbara Monohan: Chairman Delfino spoke briefly about Mrs. Monohan’s extensive knowledge and experience with the Taxi & Limo Commission. She has been involved with the Taxi & Limo Commission since day one, and opened up the communication with Mr. O’Rourke.

On motion of Chairman Delfino, seconded by Legislator Donovan the motion to approve the Resolution confirming the appointment for Barbara Monohan, as Chairman and Chief Executive Officer for the Taxi and Limousine Commission was carried by a vote of 5-0.

Walter Bell: Chairman Delfino stated the Board Chairman had recommended that Mr. Bell be considered for an appointment as a member of the Taxi & Limo Commission. Mr. Bell recently had surgery so he was unable to be here today. The Committee will put the Resolution out to the floor, to be referred back to our committee so we can bring him in to interview him for the appointment. Chairman Delfino went on to say that Mr. Bell has been involved in the Taxi and Limousine industry for 25 years. He recently resigned his position as President of the Limousine Industry Council in order to be considered for this position. He has also attended almost every meeting the Taxi & Limo Commission has had, because of his interest. It makes sense

to have someone with that kind of background to take on the issues that face us between New York City and Westchester County. Chairman Delfino supports this. It will be put on the Blue sheet for tonight’s Board Meeting.

On motion of Legislator Swanson, seconded by Legislator Donovan the motion to approve the resolution recommending the appointment of Walter Bell as a member of the Taxi and Limousine Commission was carried by a vote of 5-0.

INDUSTRIAL DEVELOPMENT AGENCY: (RE-APPOINTMENTS)

Chairman Delfino stated that in all fairness he feels that IDA has done a good job in Westchester County. It is a two year term and all four of the re-appointments expire on December 31, 1998, they really expired in 1996 but not action has been taken We are coming to the end of our term and we have to do something with all these recommended appointments and reappointments. These individuals will only be serving one year. When the new County Executive comes in, he may not choose to reappoint them again. It is not for a long period of time, and is worth it to keep the IDA going with the platform and program which is working very well with partnership.

On motion of Chairman Delfino, seconded by Legislator Donovan the motion to approve the Resolutions confirming the reappointments of Louis Heithaus, Charles Ade Simmons, E. Virgil Conway and John J. Bresnahan as members of the Industrial Development Agency were approved by a vote of 4-0. Legislator Swanson signed them out without prejudice.

YOUTH BOARD: (Reappointment - Discussion) Chairman Delfino asked Barbara Monohan if she could get the answers to the questions the Committee had in regards to Dean H. Reben.

PLUMBING BOARD: (Appointments - Discussion) Chairman Delfino stated that he will begin bringing them in at the next meeting. There has been much discussion regarding the legislation. We would like to see this committee go through the process of working in all categories of the plumbing industry to insure ourselves that they are doing a satisfactory job with the new legislation, which is very complex.

COMMISSIONER APPOINTMENT: (Discussion) Chairman Delfino stated that he has asked the Majority Leader and the Minority Leader several times to discuss with their caucuses what to do with Susan Eggington. They have never gotten back to him. Chairman Delfino thinks at this point in time, this Committee should receive and file this, let her stay in her current position and let the new County Executive decide what he wants to do with that position.

On motion of Legislator Swanson, seconded by Chairman Delfino, the motion to receive and file the appointment of Susan Eggington as Commissioner of General Services was approved by a vote of 3-2. Legislators Donovan and Spreckman voted no.

COMMUNICATIONS:

On motion of Legislator Swanson, seconded by Legislator Young the motion to receive and file a proposed local law amending the title of Administrator of General Services to Commissioner of General Services was approved by a vote of 3-0. Legislators Donovan and Spreckman voted no.

ETHICS CODE: Mr. Vitagliano stated that he and Mr. Ochacher met with the County Attorney and reviewed the opinion letter that she had sent down regarding the draft code of ethics that we put together as well as the draft that the AD HOC Committee had recommended. Based upon those discussions, they made some major modifications where the County Attorney had the biggest problems. Areas where

we tried to regulate the conduct of non County employees, they thought we were over regulating that. We had to tighten up some areas. We tried to make some distinctions between ministerial acts and discretionary acts. The state code is stricter than we were proposing it to be, as it related to conflicts. Based on that, we passed muster with the County Attorneys office. We should have a draft in about a week to give to this committee for questions and comments. The time table would be to have this committee put it on the agenda for the meeting of October 20th, setting a public hearing. Then we would put it back in to committee to make any final changes. The County Attorney’s office has responded tremendously to our requests and they have provided very good comments. Chairman Delfino thanked Mr. Vitagliano for all the work he and Mr. Ochacher have put into this.

On motion of Legislator Spreckman, seconded by Legislator Donovan the motion to approve the Resolution authorizing the County to designate the Convention and Visitors Bureau, LTD. as the tourist promotion agency for the County, was carried by a vote of 5-0.

The next meeting is scheduled for Tuesday, October 14, 1997 at 9:00 a.m.

Legislator Donovan motioned to adjourn the meeting at 9:38 a.m. and was seconded by Legislator Spreckman. The motion was carried by a vote of 5-0.
