The Chair called the meeting to order at 1:16 p.m.

 

Resolution/Local Law – IMA of New York City Trade Waste

Commission:  Legislator Stewart-Cousins described the purpose of

the law, which will allow Westchester to work reciprocally with NYC

on shared information needed for licensing decisions.  The law was

originally signed out on August 7th, 2000.

 

Legislator Latimer moved the legislation for public hearing. 

Seconded by Legislator Ryan.  All in favor 5-0.

 

The Chair asked Ms. Stacey Dolgin-Kmetz(Cty.Atty. Office) and

Mr. Tom Gardiner to address the committee on the revised proposal

on the Weapon Free Safety Zone law.

 

Ms. Dolgin-Kmetz stated that there were two revisions of the

Proposed Local law submitted to the Chair of the Legislation

Committee on September 29, and October 2, 2000.

September 29th, 2000 revised proposal changes the title

of the Local Law from “Weapon-Free School Safety

Zone Law” to “Weapons-Free School Zone Law” as indicated

in the October 2, 2000 memorandum.

The revised proposal addresses substantive issues and makes certain technical corrections.

          1.  The affirmative defenses in Sections 532.11

         and Section 532.21 have been reclassified as exceptions;

                             2.  An exception for the discharge and possession

         of a firearm while lawfully hunting has been added as paragraph

         “c” of subdivision two of Section 532.11 and as paragraph “d”

         of subdivision two of Section 532.21.

                             3.  An exception in Section 532.31 for police

         officers, federal law enforcement officers and peace officers

         has been broadened to encompass both possession and

         discharge.

                             4.  The penalty provision in Section 532.41 has

         been altered by providing that first offenses are punished

         less severely than second and subsequent offenses.

 

After much discussion about distance, signage, safety and penalties,

it was agreed to continue the discussion with Administrative officials

and interested parties including Westchester County Firearms Owners Association at the next Legislation Committee meeting on

Tuesday, October 10, 2000.  A date will then be scheduled for a public hearing.

Legislator Oros approved the minutes of September 25, 2000. 

Seconded by Legislator Abinanti.  All in favor 5-0.

 

Legislator Abinanti made a motion to adjourn.  Seconded by

Legislator Oros.  All in favor 5-0.
