Legislator Stewart-Cousins called the meeting to order at 1:20 p.m.
The Chair requested Mr. Jay Hashmall, Deputy County Executive and Mr. Dave Meyers address the committee on the proposed amendments to the Westchester County Solid Waste and Recyclables Collection Law.
Mr. Hashmall informed the committee that there are 3 technical amendments that the Administration is recommending;
· Add definition of subsidiary to law
· Allow Class C-2 Haulers to also engage in Class C-1 activities to avoid having to be licensed twice and in order for
C-2 Haulers to conduct the full range of Class C activities.
· Allow the executive Director of Solid Waste Licensing to act as the County Liaison for purposes of transmitting all Fingerprint Cards and Fees to CJS, as well as review all reports issued by the CJS.
Mr. Meyers gave each member a package which included a comparison of projected revenue: existing law vs amended law; breakdown of hauler revenues and hauler types. (copy on file)
Mr. Hashmall stated the proposed fee structure allows the solid waste commission to be tax-levy neutral. He informed the committee that

this proposed fee structure;
· Legislatively changes truck fees for Class A and C-2 Haulers from $500 per truck to $1,000 per truck;
· Within the Solid Waste Commission, set the truck fees for Class D Haulers at $1,000 per truck;
· Legislatively achieves parity by changing transfer station operation fees from $10,000 to $20,000 for 0perators which process materials other than recyclables.
Mr. Hashmall stated that the County Attorneys office and the Budget office have reviewed the fee structure and found a net difference revenue of $ 400,000 to $500,000 short. He also stated that in order to meet the deadlines, the fees will need to be increased. Mr. Hashmall informed the committee that the application process has started and he suggested that the committee act promptly to expedite this legislation.
After much discussion, the Chair stated that both Local Laws would require a public hearing.
Legislator Abinanti made a motion to sign-out the legislation for all purposes. Seconded by Legislator Ryan. All in favor 7-0.
The Chair acknowledged receipt of items submitted by Legislators Mosiello and Spreckman, for the 2000 State Legislative Package.

Legislator Maisano made a motion to approve the minutes with a change on page 2, under trash haulers fingerprint federal data base to federal fingerprint data base. Minutes seconded by Legislator Oros. All in favor 7-0.

DISCUSSION:
Changing the time of the Legislation Committee meeting.
Suggestion to hold the meetings at 12:00 noon. The Chair will write a letter to the Rules Committee in reference to revisiting the mandatory closing time of the Blue Sheet. A decision will be made at the next meeting.
The Chair informed the committee that the next meeting will take place on February 7th, 2000.
Legislator Maisano moved to adjourn the meeting. Seconded by Legislator Abinanti. All in favor 7-0.
