M I N U T E S COMMITTEE ON LEGISLATION TUESDAY, OCTOBER 28, 1997 11:00 A.M.

The meeting was called to order at 11:10 a.m. by Legislation Chairman, Tom Abinanti. The minutes of Tuesday, October 14, 1997, were reviewed. Motion to approve was made by Legislator Mosiello, seconded by Legislator Delfino, and carried 3-0. Mr. Latimer was out for the vote. Chairman Abinanti gave a brief overall explanation of Item C88 which is the proposed local law adding Chapter 635 to the Laws of Westchester County, relating to the consideration of Project Labor Agreements in connection with the purchase of construction goods and services for major construction projects. This law incorporates provisions of Executive Order 1-1997 and accommodates issues addressed by the Appellate Division in a lawsuit regarding project labor agreements. Tom Gardiner of the County Attorneys office explained that the proposed project labor agreement legislation will advance the purposes of the public bidding statue to obtain the lowest bid. Mr. Gardiner said decisions are made by the individual department heads and noted that the law does not mandate agreements but only authorizes them. The members of the Committee reviewed the contents of the proposed project labor agreement law which included sections on its objectives, the impact analysis of project labor agreements and its implementation and content. Mike Whalen, representing Local 380, said there is no down side for the County and labor seems to be in agreement with the proposed law. Legislator Delfino said that the matter was discussed in the Economic Development Task Force, noting that the Minority Caucus sought additional information. He asked Legislator Abinanti to relay todays discussion to them before the Board votes. The Committee members were in agreement and on the motion of Legislator Mosiello, the local law was moved, for all purposes and seconded by Legislator Delfino. Motion carried 4-0.
The next meeting of the Legislation Committee will be held on Wednesday, November 12 at 11 a.m., to discuss the Proposed Electrician Licensing Law.
