Earlier on this date, the Board held a Public Hearing to listen to public comment on three items dealing with filling a vacancy in the Office of County Executive. After the Public Hearing, the Legislation Committee met. The meeting commenced at 11:30 AM.

 

Leg. Noto moved to sign-out item "B", to require a special election to be held for the Office of the County Executive in the event a vacancy occurs in that office and this legislation shall take effect immediately upon the approval by the electorate at the November 5, 1996 election. This motion was seconded by Leg. Mosiello. All in favor [5-0]. This item passed unanimously with Leg. Oros voting without prejudice.

 

Leg. Latimer moved to sign-out legislation item "A", which would require a special election to fill the vacancy and the legislation should take effect on January 1, 1998 if approved by the Electorate this November. . This motion was seconded by Leg. Oros. Leg. Oros, Leg. Abinanti and Leg. Latimer signed without prejudice, Leg. Mosiello and Leg. Noto voted in the negative [3-2].

 

Leg. Latimer moved to sign-out legislation item "C", which prohibits a County Executive appointed by the Board of Legislators pursuant to section 110.51(2) of the law of Westchester County from seeking election to the office of County Executive if he has served as County Executive at any time during the four (4) months preceding the Election, (effective upon approval by the voters at the Nov. 5, 1996 election). This motion was seconded by Leg. Oros. Leg. Abinanti, Leg. Latimer and Leg. Oros voted without prejudice, Leg. Noto and Leg. Mosiello voted in the negative [3-2].

Leg. Mosiello moved to adjourned. The meeting adjourned at 11:40 AM.
