The meeting commenced at 3:30 PM.

 

The first order of discussion was the minutes of July 9, 1996. Leg. Mosiello moved to accept, seconded by Leg. Abinanti. Leg. Oros abstained [2-0].

 

The Committee then discussed bar closings. Frank Cappola, the attorney representing bar owners, urged the reconsideration of bar closing. Mr. Cappola stated that there was new information that he wanted to present to the Committee. The Committee contemplated the motion to reconsider this item; however the Committee did not do so since only three members were present.

 

Next, the Committee continued discussion of item B-3, a proposed local law requiring a special election to fill a vacancy in the Office of County Executive. Leg. Abinanti distributed two new proposals. The first deals with requiring a special election in the event of a vacancy in the Office of County Executive. The second amends the qualifications for the Office of County Executive to prohibit anyone who is serving as the appointed County Executive from running for the office within 4 months of serving as appointee. This second proposal is an attempt to eliminate the advantage of "artificial incumbency". Leg. La Motte questioned whether this was constitutional.

Since there were only 3 members present the Committee did not take any action on this item. Leg. Oros suggested that these drafts should be distributed to all of the Legislators for review. Leg. Abinanti requested that a separate folder be created for this item.

 

Motion to adjourned by Leg. Oros, seconded by Leg. Mosiello. The Meeting adjourned at 4:30 PM.
