COMMITTEE ON THE ENVIRONMENT

DISCUSSION:

Chair Kaplowitz called the meeting to order at 2:33 p.m.  The minutes of February 28th, (joint meeting with the Committee on Budget and Appropriations), were noted for the additional change on page #2, accepted and moved on the motion of Legislator Pinto, seconded by Legislator Kaplowitz, with all in favor.  The minutes of February 8th, 15th and 29th were also moved on the motion of Legislator Pinto, seconded by Legislator LaMotte, and the three minutes were carried with a vote of 4-0.

 

The next item for discussion involved the Home Rule Resolution Request (A.9537 and S.5256C), regarding the use of parkland to create an easement for a land lot.  Michael Swee handed out maps and an easement summary of the parcel in question.  He further explained that when the Pocantico Lake Property was purchased by the County in 1992, and during the title search/survey there was an oversight of a small piece property extending between the private parcel and the roadway, which isolates the property-owner from the main road.  The area is less than 1,000 square feet, and passing this resolution will allow the owner to keep his existing driveway (of 25-years).  The resolution was approved and moved on the motion of Legislator Pinto, seconded by Legislator LaMotte, and carried with a vote of 4-0.

Chair Kaplowitz noted that he received the results from the MTBE study performed on his (home) well on February 17th, and no MTBE’s were found.  Legislator LaMotte interjected that last week she attended a discussion in Pound Ridge on MTBE where there were representatives from the State, Shell Oil Company and the WC/Health Department.  The wells in the Scott’s Corner area were tested for MTBE’s, and an unexpected side affect occurred, which was high amounts of radon found in the water.  Legislator LaMotte suggested that a joint meeting with the Health Committee and the Health Department should be planned to discuss this issue in more detail.  Legislator Kaplowitz spoke on the MTBE Petition, noting that he has already gotten signatures and suggests that a copy of the petition be distributed to Municipal Officials, Town Supervisors, etc., and also be presented at other public gathering places for signatures.

 

Hope Corbin was asked to make her presentation regarding a recent visit to a local gardening nursery to gather information on the public awareness of the sale and use pesticides.  She stated that she asked the managing attendant if he could provide her with information regarding the use of pesticides, and was directed to a wall of one-page pamphlets (in ENV file), which were copyright and distributed by the nursery.  Ms. Corbin added that on the harsh chemical bottles, there are booklets attached to explain that the product is to be used exactly as directed, or the company is not liable for misuse complications.  She also noted that no pesticide warning signs are posted on/at the register counter.  Chair Kaplowitz suggested that memo be sent to Elaine Price at the Office of Consumer Affairs, along with the report and pamphlets. The agenda items were reviewed next and the following items were received and filed:  #’s 16, 17 on the motion Legislator Maisano, seconded by Legislator Pinto;  #20 on the motion of Legislator Pinto, seconded by Legislator Maisano; #21 on the motion of Legislator Pinto, seconded by Legislator LaMotte; and #22 on the motion of Legislator LaMotte, seconded by Legislator Pinto, all motions were carried with a vote of 4-0.  Chair also requested that a memo be directed to the Planning Department requesting an update on the Stokes Green Property, and comments on the Riviera Club to plan upcoming meetings.

 

With no further business to discuss, on the motion of Legislator Pinto, seconded by Legislator Maisano, the meeting adjourned at 3:10 p.m.
