Acting Chairman Kaplowitz called the meeting to order at 10:15 a.m.

 

On motion of Legislator LaMotte, seconded by Legislator Young, the motion to approve the Minutes of November 5, 2001 was carried by a vote of 5-0.

 

D11:  Designation of Outside Counsel:  Designating an atto9rney to be retained to represent WestchesterCommunity College, Joseph N. Hankin, President of the College, et al in the lawsuit of Ernest Simpson v. County of Westchester, et al.  (10/01/01)

 

·       This item was discussed in detail at a previous meeting.

·       The CountyAttorney reminded the Committee that there is a marked difference the College and the CountyAdministration in how to handle this case, therefore a conflict exists requiring the designation of outside counsel for the college.

·       Legislator Kaplowitz disclosed that one of the persons from the designated law firm is a financial planning client of his.  CountyAttorney opined that disclosure was sufficient.

 

On motion of Legislator Young, seconded by Legislator Stewart-Cousins, the motion to approve this item was carried by a vote of 5-0.

2002 Capital Budget:

 

Refuse District: (C127):

 

There are no new projects or existing projects which require modifications to appropriations in the 2002 Capital Budget.

 

Sewer & Water Districts:  (C135):

 

·       SM006:  Mamaroneck WWTP – Variable Frequency Drives:  to replace existing equipment.  $600,000 cash to capital.  From non-recurring to cash to capital so work can be designed and done and the funds do not become a year end issue.

·       SNR20:  Mamaroneck/New Rochelle Twin Sludge Foremain  same appropriation as 2001

·       SNR75:  Pump Station Rehabilitation – New Rochelle SSD:  has been budgeted for all along and is now being appropriated from proper account.  Brought out from the “mother” account SW075, which is a holding place and method of tracking.  These become “real” projects when they go out to sewer districts.

·       SPK01:  Peekskill WWTP Performance Maintenance:  Of the $300,000 appropriation for 2002, $200,000 bonds, $100,000 cash to capital.  Replacing equipment which is reaching the end of its useful life.  Satisfying the reliability of the existing facility.  This will stay, it will not be discarded if the plant is expanded.

·       SPS03:  NorthYonkersPumpStationMaintenanceBuilding:  appropriation is the same as 2001

·       SPS06:  North Yonkers Pump Station Emergency Generator:  This is a new project.  Lost both feeders at the same time.   DEC told us to look into an emergency generator.  Cooperating with DEC, didn’t want it to go into a Consent Order.

·       SY001:  Yonkers Joint Treatment Plant Grit Removal Equipment:  Up $500,000 from last year.  This is being designed in-house.  Recommended additional grit storage.  Wasn’t enough money in the project to accomplish Black & Veatch recommendations.

·       WD302:  County Water District #3, Water Distribution System:  increase in cost is attributed to cost escalation over the years.  Under review:  $1.7 million – will look at system as things occur out at the reservation.
