42.* COUNTY ATTORNEY: Compromise of Medicaid Claim: Authorizing the County Attorney to compromise the Medicaid Claim of Westchester County in the John N. Turner Estate. (11/27/00)
On motion of Legislator LaMotte, seconded by Legislator Stewart-Cousins, the motion to approve this item was carried by a vote of 7-0 with Legislator Carsky signing Without Prejudice.
4.* Duty Disability Retirement Benefits: Proposed Act electing to provide duty disability retirement benefits for sheriffs, deputy sheriffs, undersheriffs and correction officers pursuant to the duty disability retirement provisions of the New York State Retirement and Social Security Law. (11/27/00)
· This legislation would allow Westchester County the ability to provide its sheriffs, undersheriffs, deputy sheriffs and correction officers who are disabled by a line of duty injury or specified illnesses, with a retirement benefit of 75% of their final average salary.
· There are 800 Correction Officers and 40-50 Superior Officers.
· The $800,000 buy-in option can be paid over ten years. Most other counties have opted in. A list will be provided.
· This will help OT costs to decrease.

20.* E911 Surcharge Funds: Proposed Act authorizing the expenditure of E911 surcharge funds. (11/27/00)
· Until 2000, previous practice has been not to seek authorization for E911 expenditures from the Board, although the total amount to be expended was noted in the Budget.
· The County Attorney opined that authorization from the Board is required for the expenditure of E911 funds.
· This is a request for the expenditure of the E911 surcharge funds for the year 2001.
On motion of Legislator Kaplowitz, seconded by Legislator LaMotte, the motion to approve this item was carried by a vote of 7-0 with Legislator Swanson signing Without Prejudice.
17.* Budget Transfer Resolution: Proposed Resolution transferring funds within various departments 2000 Operating Budgets in the total amount of $785,400. (11/27/00)
· IT: for the purchase of network and related desktop equipment so the department can meet the demands of the new Cablevision data network contract.
· Probation: to purchase vehicles for the new Day Reporting Program.
· Public Administrator & Solid Waste Commission: so county can close books in accordance with the year-end audit.
· DPW: to cover the increase in electricity and gasoline costs experienced during the year.
· Committee requested a revised schedule of contractual services for all items.

18.* Budget Amendment: Proposed Act amending the 2000 County Budget various departments. (11/27/00)
· Consumer Protection: to cover deficits in specific accounts as part of the year-end close
· Labs & Research: to cover services by DPW for the increase in electrical and steam charges
· Probation: to cover deficits in Annual Regular & OT accounts
· DOT: to cover the increase in the cost of diesel fuel
· DPW: to cover increase in costs of electrical usage
· Misc. Budget: to cover the charge for the early retirement incentive
On motion of Legislator Kaplowitz, seconded by Legislator Stewart-Cousins, the motion to approve this item was carried by a vote of 7-0.
21.* IMA with the Village of Buchanan: Authorizing the County to enter into an IMA with the Village of Buchanan whereby the County would provide funds to the Village for the purchase of tables, chairs and kitchen appliances for use in a kitchen, pantry and lounge area for Senior citizens that the Village is constructing as part of an expanded community center. (11/30/00 via Chairman Latimer)
· The County will provide $15,000 to help offset the cost of tables, chairs and kitchen appliances.
· The term of the IMA will be one year.
On motion of Legislator Swanson, seconded by Legislator Stewart-Cousins, the motion to approve this item was carried by a vote of 6-0 with Legislator LaMotte out for the vote and Legislators Young and Carsky signing without Prejudice.
22.* IMA with the Town of Cortlandt: authorizing the County to enter into an IMA with the Town of Cortlandt whereby the County would provide funds to the Town for an independent analysis of the impact on the Town and its residents of the operation of the Countys Sprout Brook Ash Pit. (11/30/00 via Chairman Latimer)

· The County will pay the town $15,000 which the town will use to hire an independent consultant who will analyze for quality assurance and verification purposes the Countys air, soil, and water monitoring at the Sprout Brook Ash Pit.
