Minutes:

 

On motion of Legislator Darcy, seconded by Legislator Young, the motion to approve the Minutes of June 3, 1996 (12:25 p.m.), June 3, 1996 (3:00 p.m.) was carried by a vote of 5-0.

Lawsuits:

 

1. COUNTY EXECUTIVE: Proposed Legislation to fund the settlement and related expenses of a lawsuit against the County of Westchester entitled, Federal Insurance Company v. the County of Westchester. (6/3/96)

 

2. COUNTY ATTORNEY: Proposed Act authorizing the County Attorney to settle the lawsuit of Federal Insurance Company v. County of Westchester. (6/3/96)

 

3. COUNTY EXECUTIVE: Notifying the Board that he is directing the County Attorney to

intervene on behalf of the County and the Department of Social Services in Dowd, et al. v. Bane and related matters. (5/6/96)

 

4. COUNTY ATTORNEY: Authorizing the County attorney to settle the lawsuit of Joseph Brody and Marie Brody v. Thomas A. Lansen, M.D., et al. (6/3/96)

 

27. COUNTY ATTORNEY: Forwarding a Proposed Act authorizing the County Attorney to settle the lawsuit entitled Donna Marie Ezaguai f/k/n Donna Marie Hughes et al v. County of Westchester et al. (5/20/96)

On motion of Legislator Darcy, seconded by Legislator Young, the motion to go into Executive Session at 3:07 p.m. to discuss the above captioned pending litigation as well as an update on the Annis case was carried by a vote of 5-0. (Legislator Abinanti out for vote)

 

On motion of Legislator Darcy, seconded by Legislator LaMotte, the motion to come out of Executive Session at 4:10 p.m. was carried by a vote of 6-0.

After resuming regular session the following action was taken on the above captioned items:

 

1. On motion of Legislator LaMotte, seconded by Legislator Darcy, the motion to approve this item was carried by a vote of 4-0. (Legislators Abinanti and Young out for vote)

General Bond Discussion:

 

Mr. Wishnie informed the Committee that he and Mrs. Swanson met with the Budget Director on Friday, informally, to discuss the bonding issue.

Mrs. LaMotte urged that all Legislators attend whatever Capital presentations they can to get the most information possible while decisions on what goes into the Capital Budget are being made.

Mr. Phelan distributed information with regard to last fall’s bond sale (on file) which he discussed with the Committee. In the Fall of 1995, $72 million worth of bonds were sold. Mr. Phelan explained that 1996 may be $74-$80 million and urged that 1995 be used as a model.

Mr. Abinanti expressed his concern as to whether the County can afford an increase in debt service. Mr. Phelan stated that the assumption that if debt service goes up tax levy goes up, is incorrect - there is no direct correlation between debt service and tax levy.
