SPECIAL MEETING

COUNTY BOARD OF LEGISLATORS

FEBRUARY 11, 2003 (7:30 P.M.)

The County Board of Legislators met in Special Session.

The Honorable Lois Bronz in the Chair.

The Chair opened the meeting with the salute to our flag and an invocation.

The roll call resulted as follows:

Legislators:  Young, Maisano, Alvarado, Kaplowitz, LaMotte, Latimer, Mosiello, Oros, Pinto, Rogowsky, Ryan, Stewart-Cousins, Wishnie, Chair – 14.

Absent:  Legislators:  Abinanti, Spreckman, Swanson -3.

SPECIAL ORDER:  CHAIR OF THE BOARD:  2003 County Operating Budget:  ACT 21-2003:  Act amending the 2003 County Operating Budget for the purpose of abolishing certain positions in various County departments and reducing appropriations within various County departments in conformance with the County’s Contingency Resolution 1-2003 adopted January 6, 2003.

The Chair presented the following report and Act and moved that the report be received, filed and approved and the Act adopted, which motion was carried by the following vote: 

AYE:  Legislators:   Young, Alvarado, Kaplowitz, Latimer, Pinto, Ryan, Stewart-Cousins, Wishnie - Chair – 9.

NAY:  Legislators:  Maisano, LaMotte, Mosiello, Oros, Rogowsky – 5.

On motion of Mr. Wishnie, seconded by Mr. Kaplowitz, the motion to reconsider this item failed by the following vote:

AYE:  Legislators:  Maisano, LaMotte, Mosiello, Oros – 4.

NAY:  Legislators Young, Alvarado, Kaplowitz, Latimer, Pinto, Rogowsky, Ryan, Stewart-Cousins, Wishnie, Chair – 10.

SPECIAL ORDER:  CHAIR OF THE BOARD:  County Tax Levy:  ACT 22-2003:  Act fixing and determining the amounts of the County and Special District Taxes for 2003 and levying such amounts upon the real property liable therefore.

The Chair presented the following report and Act and moved that the report be received, filed and approved and the Act adopted, which motion was carried by the following vote: 

AYE:  Legislators:   Young, Alvarado, Kaplowitz, Latimer, Pinto, Ryan, Stewart-Cousins, Wishnie - Chair – 9.

NAY:  Legislators:  Maisano, LaMotte, Mosiello, Oros, Rogowsky – 5.

On motion of Mr. Wishnie, seconded by Mr. Kaplowitz, the motion to reconsider this item failed by the following vote:

AYE:  Legislators:  Maisano, LaMotte, Mosiello, Oros – 4.

NAY:  Legislators Young, Alvarado, Kaplowitz, Latimer, Pinto, Rogowsky, Ryan, Stewart-Cousins, Wishnie, Chair – 10.

The Chair of the Board recessed the meeting until Thursday, February 13, 2003 at 5:00 p.m.

The Chair reconvened the meeting on Thursday, February 13, 2003 at 5:10 p.m.

The roll call resulted as follows: 

Legislators:  Young, Abinanti, Alvarado, Kaplowitz, LaMotte, Latimer, Pinto, Rogowsky, Ryan, Stewart-Cousins, Wishnie, Chair – 12.

Absent:  Legislators:  Maisano, Mosiello, Oros, Spreckman, Swanson – 5.

SPECIAL ORDER:  CHAIR OF THE BOARD:  Tax Distribution Tables:  ACT 23-2003:  Act fixing the Tax Distribution Tables for the County, County Water District No. 1, Refuse Disposal District No. 1, each of the thirteen Sanitary Sewer Districts in the County, and adjustments thereto.

Mr. Wishnie presented the following report and Act and moved that the report be received, filed and approved and the Act adopted, which motion was carried by the following vote: 

AYE:  Legislators:   Young, Alvarado, Kaplowitz, Latimer, Pinto, Ryan, Stewart-Cousins, Wishnie - Chair – 9.

NAY:  Legislators:  Abinanti, LaMotte, Rogowsky – 3.

On motion of Mr. Wishnie, seconded by Mr. Ryan, the motion to reconsider this item failed unanimously.

SPECIAL ORDER:  CHAIR OF THE BOARD:  County Tax levy: ACT 24-2003:  Act fixing and determining the amounts of County taxes and adjustments thereto; the Special District Taxes, and adjustments thereto; and other charges against the various towns and cities in the County of Westchester, and adjustments thereto; and levying such apportioned amounts for the purposes therein set forth against such towns and cities.

Mr. Wishnie presented the following report and Act and moved that the report be received, filed and approved and the Act adopted, which motion was carried by the following vote: 

AYE:  Legislators:   Young, Alvarado, Kaplowitz, Latimer, Pinto, Ryan, Stewart-Cousins, Wishnie - Chair – 9.

NAY:  Legislators:  Abinanti, LaMotte, Rogowsky – 3.

On motion of Mr. Wishnie, seconded by Mr. Ryan, the motion to reconsider this item failed unanimously.

the Board adjourned.
