COUNTY BOARD OF LEGISLATORS

DECEMBER 9, 2002


The County Board of Legislators met pursuant to adjournment.

 

The Honorable Lois Bronz in the Chair.

 

The Chair opened the meeting with the salute to our flag and an invocation.

 

The roll call resulted as follows:

 

Legislators:  Oros, Abinanti, Alvarado, Kaplowitz, LaMotte, Latimer, Maisano, Mosiello, Pinto, Rogowsky, Ryan, Spreckman, Stewart-Cousins, Swanson, Wishnie, Chair – 16.

 

Absent:  Legislator:  Young - 1.

 

Motion – Approval of Minutes.  Mrs. Stewart-Cousins moved that the minutes of November 25, 2002, be approved – Carried.

 

UNFINISHED BUSINESS:  Parks Board Appointment:  COMMITTEE ON COUNTY OFFICERS AND DEPARTMENTS: RES 216-2002:  Confirming the appointment of Thomas F. Secunda as a member of the Westchester County Parks, Recreation and Conservation Board.

 

On motion of Mrs. Swanson, the following item was recommitted.

 


UNFINISHED BUSINESS: Parks Board Appointment:  COMMITTEE ON COUNTY OFFICERS AND DEPARTMENTS: RES 217-2002:  Confirming the appointment of Gussie Sanzillo as a member of the Westchester County Parks, Recreation and Conservation Board.

 

On motion of Mrs. Swanson, the following item was recommitted.

 


COMMUNICATION:  COUNTY EXECUTIVE:  Mortgage Tax Receipts:  Proposed Act authorizing the Commissioner of Finance to pay mortgage tax receipts to cities, towns and villages was on motion of Mrs. Stewart-Cousins received, filed and referred to the Committee on Budget and Appropriations.

 

COMMUNICATION:  COUNTY EXECUTIVEBond Act:  Authorizing the issuance of up to $950,000 to finance the Parkwide Comfort Station rehabilitation project (RGIP2) was on motion of Mrs. Stewart-Cousins received, filed and referred to the Committee on Budget and Appropriations.

 

COMMUNICATION:  COUNTY EXECUTIVEGreenburgh Homeless Housing Facility:  Proposed Local Law authorizing an amendment to a lease between Westchester and the Town of Greenburgh for a six acre site was on motion of Mrs. Stewart-Cousins received, filed and referred to the Committee on Budget and Appropriations.

 

COMMUNICATION:  COUNTY EXECUTIVEBudget Amendment:   Proposed Act amending the 2002 County Clerk Operating Budget and the District Attorney Operating Budget was on motion of Mrs. Stewart-Cousins received, filed and referred to the Committee on Budget and Appropriations.

 

COMMUNICATION:  COUNTY EXECUTIVETransfer Resolution:  Proposed Resolution transferring funds within the 2002 Operating Budget-District Attorney Budget was on motion of Mrs. Stewart-Cousins received, filed and referred to the Committee on Budget and Appropriations.

 

COMMUNICATION:  HON. MICHAEL KAPLOWITZ:  Phase II Stormwater Issues:  Forwarding information on stormwater and problems relating to Stormwater was on motion of Mrs. Stewart-Cousins received, filed and referred to the Committee on the Environment and Health.

 

COMMUNICATION:  HON. VITO PINTO:  Playland:  Forwarding correspondence from the Rye Figure Skating Club regarding the Playland Ice Casino was on motion of Mrs. Stewart-Cousins received, filed and referred to the Committee on Parks.

 

COMMUNICATION:  HON. VITO PINTO AND HON. URSULA LaMOTTE:  Mountain Lakes Park:  Forwarding correspondence from the Town of North Salem Supervisor regarding the camps at Mountain Lakes Park was on motion of Mrs. Stewart-Cousins received, filed and referred to the Committee on Parks and the Committee on Budget and Appropriations.

 

COMMUNICATION:  HON. VITO PINTO:  FCS-Eastchester Child Development Center:  Correspondence from the Town of Eastchester regarding FCS obtaining a long term lease on the property occupied by the Eastchester Child Development Center was on motion of Mrs. Stewart-Cousins received, filed and referred to the Committee on Community Affairs and the Committee on Budget and Appropriations.

 

COMMUNICATION:  HON. LOU MOSIELLO:  Cell Phone Use: Article from TJN regarding the dangers of wireless telephone use while driving was on motion of Mrs. Stewart-Cousins received, filed and referred to the Committee on Legislation.

 

COMMUNICATION:  HON. URSULA LaMOTTE:  EIS_WCC Master Plan:  Forwarding a constituent recommendation regarding the WCC Facilities Master Plan was on motion of Mrs. Stewart-Cousins received, filed and referred to the Committee on Community Affairs and the Committee on the Environment and Health.

 

COMMUNICATION:  HON. LOIS BRONZ:  Support for Dairy Industry:  Forwarding a resolution from the Tioga County Legislature in support of the dairy industry was on motion of Mrs. Stewart-Cousins received, filed and referred to the Committee on Legislation.


COMMITTEE ON BUDGET & APPROPRIATIONS:  Land Conveyance:  ACT__________2002;  Act authorizing the conveyance of approximately 4,090 of square feet of County property along the County’s Putnam right-of-way to Militello Restaurant for $37,500.00.

 

On motion of Mr. Wishnie, the following item was recommitted to the Committee on Budget and Appropriations and referred to the Committee on Parks.

 


COMMITTEE ON BUDGET & APPROPRIATIONS AND THE COMMITTEE ON HOUSING:  Rye City Affordable Housing Environmental:  RES 224-2002:  Finding that there will be no significant impact on the environment from the issuance of County bonds to fund the cost of land acquisition in the City of Rye for purposes of affordable housing. 

 

Mr. Wishnie presented the following Resolution and moved its adoption, which was declared adopted by a vote of 15-0.

 

Mr. Abinanti was not present when the vote was taken.


COMMITTEE ON BUDGET & APPROPRIATIONS AND THE COMMITTEE ON HOUSING:  Rye City Affordable Housing:  (BOND) ACT 257-2002:  Authorizing the issuance of up to $472,000 in bonds to fund the cost of land acquisition in the City of Rye for purposes of affordable housing. 

 

Mr. Wishnie presented the following Report and Act and moved that the Report be received, filed and approved and the Act adopted, which motion was defeated by the following vote:

 

AYE:  Legislators:  Stewart-Cousins, Alvarado, Kaplowitz, Latimer, Pinto, Rogowsky, Ryan, Wishnie – 8.

 

NAY:  Legislators:  Oros, LaMotte, Maisano, Mosiello, Spreckman, Swanson, Chair - 7.

 

Mr. Abinanti was not present when the vote was taken.

 

On motion of Mrs. Bronz, seconded by Mr. Wishnie, the motion to reconsider the vote on this item was carried by the following vote:

 

AYE:  Legislators:  Stewart-Cousins, Abinanti, Alvarado, Kaplowitz, Latimer, Pinto, Rogowsky, Ryan, Wishnie, Chair – 10.

 

NAY:  Legislators:  Oros, LaMotte, Maisano, Mosiello, Spreckman, Swanson - 6.

 

On motion of Mr. Latimer, seconded by Mr. Abinanti, the following item was TABLED by the following vote:

 

AYE:  Legislators:  Stewart-Cousins, Abinanti, Alvarado, Kaplowitz, Latimer, Pinto, Rogowsky, Ryan, Wishnie, Chair – 10.

 

NAY:  Legislators:  Oros, LaMotte, Maisano, Mosiello, Spreckman, Swanson – 6.

 


COMMITTEE ON BUDGET & APPROPRIATIONS AND THE COMMITTEE ON HOUSING:  Rye City Affordable Housing:  ACT 258-2002:  Authorizing the County to purchase real property in the City of Rye for purposes of acquiring and conveying land to be used for affordable housing. 

 

On motion of Mr. Latimer, seconded by Mr. Abinanti, the following item was TABLED by the following vote:

 

AYE:  Legislators:  Stewart-Cousins, Abinanti, Alvarado, Kaplowitz, Latimer, Pinto, Rogowsky, Ryan, Wishnie, Chair – 10.

 

NAY:  Legislators:  Oros, LaMotte, Maisano, Mosiello, Spreckman, Swanson – 6.

 


COMMITTEE ON BUDGET & APPROPRIATIONS:  Budget Amendment:   ACT 259-2002: Proposed Act amending the 2002 County Clerk Operating Budget and the District Attorney Operating Budget.

 

Mr. Wishnie presented the following Report and Act and moved that the Report be received, filed and approved and the Act adopted, which motion was carried by the following vote:

 

AYE:  Legislators:  Stewart-Cousins, Oros, Abinanti, Alvarado, Kaplowitz, LaMotte, Latimer, Maisano, Mosiello, Pinto, Rogowsky, Ryan, Spreckman, Swanson, Wishnie, Chair - 16.

COMMITTEE ON BUDGET & APPROPRIATIONS:  Pay Plan Amendment:  ACT 260-2002:  Proposed Act amending the County’s Pay Plan.

 

Mr. Wishnie presented the following Report and Act and moved that the Report be received, filed and approved and the Act adopted, which motion was carried by the following vote:

 

AYE:  Legislators:  Stewart-Cousins, Oros, Abinanti, Alvarado, Kaplowitz, LaMotte, Latimer, Maisano, Pinto, Rogowsky, Ryan, Spreckman, Wishnie, Chair - 14.

 

NAY:  Legislators:  Mosiello - 1.

 

Mrs. Swanson was not present when the vote was taken.


COMMITTEE ON BUDGET & APPROPRIATIONS:  Mortgage Tax Receipts:  ACT 261-2002:  Proposed Act authorizing the Commissioner of the Westchester County Department of Finance to pay Mortgage Tax Receipts to Cities, Towns and Villages.

 

Mr. Wishnie presented the following Report and Act and moved that the Report be received, filed and approved and the Act adopted, which motion was carried by the following vote:

COMMITTEE ON COUNTY OFFICERS AND DEPARTMENTS:  Parks Board Reappointment:  RES 225-2002:  Confirming the reappointment of Vito Pinto as a member of the County Parks, recreation and Conservation Board.

 

Mrs. Swanson presented the following Resolution and moved its adoption, which was declared adopted.

 


COMMITTEE ON COUNTY OFFICERS AND DEPARTMENTS:  Commissioner of Elections-Reappointments:  RES 226-2002:  Confirming the reappointments of Reginald LaFayette and Carolee Sunderland as Election Commissioners of Westchester County.

 

Mrs. Swanson presented the following Resolution and moved its adoption, which was declared adopted by a vote of 15-0.

 

Mr. Abinanti was not present when the vote was taken.
