SPECIAL MEETING

The Chairman opened the meeting with the salute to our flag and an invocation.
The roll call resulted as follows:
Legislators: Abinanti, Noto, Bronz, Carsky, Kaplowitz, LaMotte, Maisano, Mosiello, Oros, Pinto, Ryan, Spreckman, Stewart-Cousins, Swanson, Wishnie, Young, Chairman – 17.
Absent: None.
Mr. Wishnie presented Act 258-2001. The Chairman then opened debate on amendments from the floor.
The
following is a true transcript of the Floor Amendments that were made and
adopted, or made and defeated, as indicated with regard to the 2002 Proposed
County Budget by the Westchester County Board of Legislators in Session on
1. A motion was made by Legislator Noto, seconded by Legislator Swanson, to delete from the Budget from Accounts 2000, 3000, and 4000, 5% across-the-board from each department.
Mr. Abinanti, seconded by Mr. Wishnie, moved to table the above-captioned motion, which motion was carried by a vote of 16-0. Mr. Pinto was not present when the vote was taken.
2. A motion was made by Legislator Noto, seconded by Legislator Swanson, to delete from the Budget from the Department of Emergency Services - Line 1010 three new fire inspectors for a total of $128,595 and also from Line 1010 one Grade XII Associate Planner - $50,910 in salary and $15,273 in benefits.
Mr. Abinanti, seconded by Mr. Wishnie, moved to table the above-captioned motion, which motion was carried by a vote of 16-0. Mr. Pinto was not present when the vote was taken.
3. A motion was made by Legislator Noto, seconded by Legislator LaMotte, to delete from the Budget from the Planning Department - Line 1010 two Grade X Planners - $144,270.
Mr. Abinanti, seconded by Mr. Wishnie, moved to table the above-captioned motion, which motion was carried by a vote of 16-0. Mr. Pinto was not present when the vote was taken.
4. A motion was made by Legislator Swanson, seconded by Legislator Maisano, to delete from the Budget from the Parks, Recreation and Conservation Department – Account 4380 – Contractual Services - $700,000.
Mr. Abinanti, seconded by Mr. Young, moved to table the above-captioned motion, which motion was carried by a vote of 16-0. Mr. Pinto was not present when the vote was taken.
5. A motion was made by Legislator LaMotte, seconded by Legislator Maisano, to delete from the Budget – Miscellaneous Budget – Special Studies – Account 2120- $375,000.
Mr. Abinanti, seconded by Mr. Young, moved to table the above-captioned motion, which motion was carried by a vote of 16-0. Mr. Pinto was not present when the vote was taken.
6. A motion was made by Legislator Oros, seconded by Legislator Swanson, to delete from the Budget – Miscellaneous Budget – Cash to Capital – Account 2200 - $450,000.
Mr. Abinanti, seconded by Mr. Young, moved to table the above-captioned motion, which motion was carried by a vote of 16-0. Mr. Pinto was not present when the vote was taken.
7. A motion was made by Legislator Carsky, seconded by Legislator Maisano, to delete from the Budget from Account 1000 – Personal Services – 3% across-the-board from all departments.
Mr. Abinanti, seconded by Mr. Bronz, moved to table the above-captioned motion, which motion was carried by a vote of 16-0. Mr. Pinto was not present when the vote was taken.
8. A motion was made by Legislator Kaplowitz, seconded by Legislator Abinanti, to delete from the Budget from the Department of Information Technology – Account 2300 - $500,000 and 10% from Accounts 3010, 3070, 3240, 3600 and 3700 totaling $60,000.
Mr. Abinanti, seconded by Mr. Young, moved to table the above-captioned motion, which motion was carried by a vote of 16-0. Mr. Pinto was not present when the vote was taken.
9. A motion was made by Legislator Kaplowitz, seconded by Legislator Abinanti, to delete from the Budget from the Law Department – 10% from Accounts 3010, 3070, 3600 and 3700 totaling $10,000.

10. A motion was made by Legislator Kaplowitz, seconded by Legislator Abinanti, to delete from the Budget from the Department of Planning – Account 4070 - $5,000.

19. A motion was made by Legislator Kaplowitz, seconded by Legislator Abinanti, to delete from the Budget from the Department of Parks, Recreation and Conservation – Account 4310 - $55,000; Account 4450 - $50,000; Account 4630 - $50,000 and Account 5124 - $8,000.

20. A motion was made by Legislator Kaplowitz, seconded by Legislator Abinanti, to delete from the Budget from the Department of Public Works – Account 2300 - $300,000.

22. A motion was made by Legislator Kaplowitz, seconded by Legislator Abinanti, to delete from the Budget from Health Insurance – Account 1680 - $1,000,000.

25. A motion was made by Legislator Kaplowitz, seconded by Legislator Abinanti, to delete from the Budget from Personal Services – Account 1010 – 43 vacancies - $1,800,000 and $540,000 in benefits.

26. A motion was made by Legislator Kaplowitz, seconded by Legislator Abinanti, to delete from the Budget from Indigent Services – Account 2090 - $200,000.

27. A motion was made by Legislator Kaplowitz, seconded by Legislator Abinanti, to delete from the Budget from Appropriated Fund Balance - $8,000,000.

28. A motion was made by Legislator Abinanti, seconded by Legislator Swanson, to delete from the Budget – from the Department of Social Services – 228900- Account 5860 - $250,000 – monies to fund move of the Volunteers of America to Grasslands Reservation.
Mr. Abinanti, seconded by Mr. Young, moved to table the above-captioned motion, which motion was carried by a vote of 16-0. Mr. Pinto was not present when the vote was taken.
29. A motion was made by Legislator Wishnie, seconded by Legislator Bronz, to approve the Report of the Committee on Budget and Appropriations.

30. A motion was made by Legislator Kaplowitz, seconded by Legislator Pinto, to remove from the table the motion to delete from the Budget from the Department of Information Technology – 160000 - Account 2400 – Additional Equipment - $432,400; from the Department of Information Technology – 160000 - Account 3600 - Printing & Office Supplies - $60,000; from the Law Department – 181000 – Litigation – Account 4923 - $10,000 and from the Department of Social Services – 22000 – Account 5960 - Indirect Services - $1,500,000.
The motion was carried unanimously.
31. A motion was made by Legislator Oros, seconded by Legislator Spreckman, to remove from the table the motion to delete from the Budget – Miscellaneous Budget 520000 - Cash-to-Capital – Account 2200 - $450,000.
Mr. Abinanti moved to amend the motion to $2,100,000, which motion was unanimously carried.
32. A motion was made by Legislator Noto, seconded by Legislator Maisano to remove from the table the motion to delete from the Budget from the Department of Emergency Services – 200000 - Account 1010 – three new fire inspectors - $128,595 and from Benefits – Account 5200 - $52,000.
The motion was carried unanimously.
33. A motion was made by Legislator Noto, seconded by Legislator Maisano to remove from the table the motion to delete from the Budget – from the Department of Emergency Services – 200000 - one Grade XII Associate Planner – Account 1010 - $50,910 in salary and $15, 273 in Benefits – Account 5200.
The motion failed by a vote of 8-9 with Legislators Noto, Carsky, LaMotte, Maisano, Mosiello, Oros, Spreckman and Swanson being recorded in the affirmative.
34. A motion was made by Legislator Noto, seconded by Legislator Maisano, to remove from the table the motion to delete from the Budget from Accounts 2000, 3000, 4000, 5% across-the-board from each department.
The motion was carried unanimously.
35. A motion was made by Legislator Noto, seconded by Legislator Maisano, to amend the motion to reflect a 1% across-the-board reduction from each department in Accounts 2000, 3000 and 4000.
The motion failed by a vote of 8-9 with Legislators Noto, Carsky, LaMotte, Maisano, Mosiello, Oros, Spreckman and Swanson being recorded in the affirmative.
36. A motion was made by Legislator Noto, seconded by Legislator LaMotte, to remove from the table the motion to delete from the Budget – Planning Department –190000 – Account 1010 – two Grade X Planners - $144,270.
The motion failed by a vote of 8-9 with Legislators Noto, Carsky, LaMotte, Maisano, Mosiello, Oros, Spreckman and Swanson being recorded in the affirmative.
37. A motion was made by Legislator Swanson, seconded by Legislator LaMotte, to delete from the Budget – Department of Parks, Recreation and Conservation – 220000 - Account 4380 – Contractual Services - $700,000.
The motion failed by a vote of 8-9 with Legislators Noto, Carsky, LaMotte, Maisano, Mosiello, Oros, Spreckman and Swanson being recorded in the affirmative.
38. A motion was made by Legislator LaMotte, seconded by Legislator Swanson, to remove from the table the motion to delete from the Budget – Miscellaneous Budget – 520000 - Special Studies – Account 2120 - $375,000.

42. A motion was made by Legislator Abinanti, seconded by Legislator Pinto, to delete from Account 9800 – anticipated federal aid - $1,000,000.
The motion was carried unanimously.
43. A motion was made by Legislator Wishnie, seconded by Legislator Pinto, to delete from the Contribution to 6N Fund – Account 4937 - $500,000.
The motion was carried unanimously.
44. A motion was made by Legislator Wishnie, seconded by Legislator Pinto to delete from the Retirement Account – 1650 - $500,000.
The motion was carried unanimously.
45. A motion was made by Legislator Wishnie, seconded by Legislator Stewart-Cousins, to delete from Health Insurance – Account 1680 - $2,000,000.
The motion was carried unanimously.
46. A motion was made by Legislator Ryan, seconded by Legislator Pinto, to delete from the Miscellaneous Budget - 520000 - Non-recurring Repairs and Replacements - Account 4310 - $750,000.
The motion was carried unanimously.
47. A motion was made by Legislator Abinanti, seconded by Legislator Bronz to remove from the table the motion to delete from the Department of Social Services – 228900-Account 5860 - $250,000 – monies to fund the move of the Volunteers of America to Grasslands Reservation.
The motion was carried unanimously.
48. A motion was made by Legislator Abinanti, seconded by Legislator Swanson to amend the motion to delete from the Department of Social Services – $250,000 - monies to fund the move of the Volunteers of America to Grasslands Reservation to reflect the proper account numbers, 225000 and Technical Services - Line 4420.
The motion was carried unanimously.
49. A motion was made by Legislator Ryan, seconded by Legislator Pinto, the motion to delete from Miscellaneous Budget - 520000 - Non-Recurring Repairs - Account 4310 – an additional $2,000,000.
The motion was carried unanimously.
Mr. Wishnie again presented Act 258-2001, as amended by the above floor amendments and moved that the report be received, filed and approved and the act adopted, which motion was declared carried by the following vote:
AYE: Legislators Abinanti, Bronz, Kaplowitz, Pinto, Ryan, Stewart-Cousins, Wishnie, Young – Chairman – 9.
NAY: Legislators Noto, Carsky, LaMotte, Maisano, Mosiello, Oros, Spreckman, Swanson – 8.
Mr. Wishnie moved to reconsider the vote just taken in the hope that it be defeated, which motion was defeated, 9 to 8, with Legislators Noto, Carsky, LaMotte, Maisano, Mosiello, Oros, Spreckman and Swanson being recorded in the affirmative.
COMMITTEE ON BUDGET AND APPROPRIATIONS: Fixing and Determining County and Special District Taxes: ACT 259-2001 (As Amended): Fixing and determining the amounts of the County and Special District Taxes for 2002 and levying such amounts upon the real property liable therefor.
Mr. Wishnie presented the following report and act and moved that the report be received, filed and approved and the act adopted, which motion was carried by the following vote:
AYE: Legislators Abinanti, Bronz, Kaplowitz, Pinto, Ryan, Stewart-Cousins, Wishnie, Young – Chairman – 9.
NAY: Legislators Noto, Carsky, LaMotte, Maisano, Mosiello, Oros, Spreckman, Swanson – 8.
