COUNTYBOARD OF LEGISLATORS

The CountyBoard of Legislators met pursuant to adjournment.

 

The Honorable George Latimer in the Chair.

 

The Chairman opened the meeting with the salute to our flag and an invocation offered by Legislator Andrea Stewart-Cousins.

 

The roll call resulted as follows:

 

Legislators:  Abinanti, Noto, Bronz, Carsky, LaMotte, Maisano, Mosiello, Oros, Pinto, Ryan, Spreckman, Stewart-Cousins, Swanson, Wishnie, Young – Chairman.

 

Absent:  Legislator Kaplowitz.

 

Mr. Abinanti moved to suspend the regular order of business for the purpose of conducting a Public Hearing – Carried.

 

PUBLIC HEARING:  Pocantico Lake Easement:  COMMITTEE ON BUDGET AND APPROPRIATIONS:  LOCAL LAW INTRO 27-2001:  Authorizing the County to grant a permanent easement over part of Pocantico Lake Park to Anthony J. Pagello and Elizabeth R. Pagello for the maintenance of a driveway to their home located at 30 Pocantico Lake Road in the Town of Mount Pleasant.

 

The Clerk presented proof of publication of the notice of Public Hearing and read the rules for its conduct.

 

There were no speakers.

 

No other person wishing to be heard, on motion of Mr. Abinanti, the Public Hearing was closed and the regular order of business was resumed.


UNFINISHED BUSINESS:  Graham Windham Environmental:  COMMITTEE ON BUDGET AND APPROPRIATIONS: RES 234-2001:  Finding that there will be no significant impact on the environment from the adoption of legislation authorizing the County to jointly acquire for parks purposes with the Village of Hastings-on-Hudson 14.25 acres of real property.

 

Mr. Wishnie presented the following resolution and moved its adoption, which was declared adopted.


UNFINISHED BUSINESS:  Graham Windham Property Acquisition:  COMMITTEE ON BUDGET AND APPROPRIATIONS:  ACT 214-2001:  Authorizing the County to acquire, as tenants in common with the Village of Hastings-on-Hudson, an interest in a 14.25 acre parcel located in the Village of Hastings-on-Hudson for parks purposes.

 

Mr. Wishnie presented the following report and act and moved that the report be received, filed and approved and the act adoption, which motion was carried by the following vote:

UNFINISHED BUSINESS:  Graham Windham Bond Act:  COMMITTEE ON BUDGET AND APPROPRIATIONS:  (BOND) ACT 215-2001:  Authorizing the issuance of $385,000 in bonds – Acquisition of Graham Windham Property.

 

Mr. Wishnie presented the following report and act and moved that the report be received, filed and approved and the act adoption, which motion was carried by the following vote:

COMMUNICATION:  COUNTY EXECUTIVE:  Gift Acceptance:  Acceptance of a gift from Liberty Lines to be used by the Westchester County Office of Tourism was on motion of Mr. Abinanti received, filed and referred to the Committee on Budget and Appropriations.

 

COMMUNICATION:  COUNTY EXECUTIVE:  Board of Plumbing Examiners Appointment:  Appointing Michael H. Alberts as a member of the Board of Plumbing Examiners was on motion of Mr. Abinanti received, filed and referred to the Committee on County Officers and Departments.

COMMUNICATION:  COUNTY EXECUTIVE:  Korean War Memorial:  Proposed legislation authorizing the County to enter into an IMA with the Town of Rye which will provide that the County will pay $10,000.00 to the Town for site work and dedication and memorial plaques for the Korean War Memorial at Crawford Park in Rye was on motion of Mr. Abinanti received, filed and referred to the Committee on Budget and Appropriations.

 

COMMUNICATION:  COUNTY EXECUTIVE:  Rehabilitation of Taxiways:  Proposed Act amending Act 140-2001 in connection with the Westchester County Airport Project entitled A0054 – Rehabilitation of Various Taxiways was on motion of Mr. Abinanti received, filed and referred to the Committee on Budget and Appropriations.

 

COMMUNICATION:  COUNTY EXECUTIVE:  Hawthorne Fire District IMA:  Proposed Act authorizing the County to enter into an IMA with the Hawthorne Fire District in connection with fire safety procedures was on motion of Mr. Abinanti received, filed and referred to the Committee on Budget and Appropriations.

 

COMMUNICATION:  COUNTY EXECUTIVE:   Valhalla Fire District IMA:  Proposed Act authorizing the County to enter into an IMA with the Valhalla Fire District in connection with fire safety procedures was on motion of Mr. Abinanti received, filed and referred to the Committee on Budget and Appropriations.

 

COMMUNICATION:  COUNTY EXECUTIVE:  2002 Proposed County Capital Budget:  Forwarding the 2002 County Capital Budget was on motion of Mr. Abinanti received, filed and referred to the Committee on Budget and Appropriations.

 

COMMUNICATION:  COUNTY EXECUTIVE:  Removal of Mercury Switches:  Proposed Local Law requiring the removal of mercury switches prior to the crushing or shredding of motor vehicles was on motion of Mr. Abinanti received, filed and referred to the Committee on Legislation and the Committee on Health.

 

COMMUNICATION:  CLERK OF THE BOARD:  Kitchawan Water District:  Forwarding the application from the Town of Yorktown re:  the Kitchawan Water District was on motion of Mr. Abinanti received, filed and referred to the Committee on Public Works.

 

COMMUNICATION:  CITIZEN COMMUNICATION:  PARSHU BHATT, ET AL:  Hate Crimes:  Forwarding a copy of their letter to the Supervisor of the Town of Yorktown regarding hate crimes against South Asians was on motion of Mr. Abinanti received, filed and referred to the Committee on Minority Affairs.

 

COMMUNICATION:  HON. URSULA LA MOTTE:  Funding for Medicaid:  Forwarding a model letter to be sent to the State Delegation in Albany re:  funding for Medicaid was on motion of Mr. Abinanti received, filed and referred to the Committee on Legislation.

 

COMMUNICATION:  CITIZEN COMMUNICATION:  RICHARD HOBBS:  Housing Needs:  Forwarding a copy of his letter to the Executive Vice President of the New Rochelle Neighborhood Revitalization Corporation regarding his housing needs was on motion of Mr. Abinanti received, filed and referred to the Committee on Housing.

 

COMMUNICATION:  HON. GEORGE LATIMER:  Security of Westchester County Facilities:  Forwarding a copy of a memorandum from the Deputy County Executive to the Commissioner of Public Safety regarding security of County facilities was on motion of Mr. Abinanti received, filed and referred to the Committee on Budget and Appropriations and the Committee on Public Safety.

 

COMMUNICATION:  CITIZEN COMMUNICATION:  CHILD ABUSE PREVENTION CENTER:  Update on Center’s Work:  Forwarding copies of letters from the Political Liaison of the Child Abuse Prevention Center to Legislators Noto, Bronz and Wishnie asking for an opportunity to appear before their Committees to provide an update on its continuing work with families throughout the County was on motion of Mr. Abinanti received, filed and referred to the Committee on Families.

 

COMMUNICATION:  CITIZEN COMMUNICATION:  WESTCHESTER YOUTH JAZZ ENSEMBLE:  Funding for Westchester Youth Jazz Ensemble:  Requesting financial help for the Westchester County Youth Jazz Ensemble was on motion of Mr. Abinanti received, filed and referred to the Committee on Budget and Appropriations.

 

COMMUNICATION:  HON. BERNICE SPRECKMAN:  Showing Animals Kindness and Respect:  Forwarding a letter from the Director of SHARK (Showing Animals Kindness and Respect) requesting that the County enact an ordinance banning traveling animal acts was on motion of Mr. Abinanti received, filed and referred to the Committee on Community Affairs.

 

COMMUNICATION:  HON. KATHERINE CARSKY AND HON. URSULA LA MOTTE:  Residential Units on County Lands:  Forwarding a copy of their letter to the County Executive asking why the County doesn’t use the residential units it owns within its various parks for affordable housing purposes was on motion of Mr. Abinanti received, filed and referred to the Committee on Housing.
COMMITTEE ON BUDGET AND APPROPRIATIONS:  Pagello Easement Environmental:  RES 245-2001:  Finding that there will be no significant impact on the environment from the adoption of a Local Law granting a permanent easement over part of Pocantico Lake Park to Anthony J. Pagello and Elizabeth R. Pagello for the maintenance of a driveway to their home located at 30 Pocantico Lake Road in the Town of Mount Pleasant.

COMMITTEE ON BUDGET AND APPROPRIATIONS:  Hillpoint IMA Amendment:  ACT 218-2001:  Authorizing an amendment to the IMA between the County and the Town of Cortlandt regarding the Hillpoint Property located in the Town.

 

Mr. Wishnie presented the following report and act and moved that the report be received, filed and approved and the act adopted, which motion was carried by the following vote:

 

AYE:  Legislators Abinanti, Noto, Bronz, LaMotte, Maisano, Mosiello, Oros, Pinto, Ryan, Spreckman, Stewart-Cousins, Swanson, Wishnie, Young – Chairman – 15.

 

NAY:  Legislator Carsky.


COMMITTEE ON BUDGET AND APPROPRIATIONS:  Radio Tower Environmental:  RES 246-2001:  Finding that there will be no significant impact on the environment from the adoption of legislation which would authorize the issuance of up to $550,000 in bonds  to cover the costs of the acquisition of wireless communications equipment for a pilot/feasibility test involving the County bus system and the construction of a radio tower in the Town of Yorktown.

 

Mr. Wishnie presented the following resolution and moved its adoption, which was declared adopted.


COMMITTEE ON BUDGET AND APPROPRIATIONS:  Radio Tower Bond Act:  (BOND) ACT 219-2001:  Authorizing the issuance of $550,000 in bonds – Acquisition of wireless communications equipment and the construction of a radio tower in the Town of Yorktown.

 

Mr. Wishnie presented the following report and act and moved that the report be received, filed and approved and the act adopted, which motion was carried by the following vote:

COMMITTEE ON BUDGET AND APPROPRIATIONS:  Traffic Enforcement IMA:  ACT 220-2001:  Authorizing the County to enter into IMA’s with municipal corporations located within the County for the purpose of implementing traffic enforcement programs for a five-year term.

 

Mr. Wishnie presented the following report and act and moved that the report be received, filed and approved and the act adopted, which motion was carried by the following vote:

COMMITTEE ON BUDGET AND APPROPRIATIONS AND COMMITTEE ON HOUSING:  Kensico Avenue Environmental:  RES 247-2001:  Finding that there will be no significant impact on the environment from the adoption of legislation to authorize the County to purchase approximately 18,500 square feet of property located at 24 South Kensico Avenue in the City of White Plains and convey the property for the purpose of providing affordable housing.

 

The following Resolution was laid “OVER” under the rules by Mr. Noto.


COMMITTEE ON BUDGET AND APPROPRIATIONS AND COMMITTEE ON HOUSING:  Kensico Avenue Property Purchase:  ACT 221-2001:  Authorizing the County to purchase approximately 18,500 square feet of property located at 24 South Kensico Avenue in the City of White Plains and convey the property for the purpose of providing affordable housing.

 

The following Act was laid “OVER” under the rules by Mr. Noto.


COMMITTEE ON BUDGET AND APPROPRIATIONS AND COMMITTEE ON HOUSING:  Kensico Avenue Bond Act:  (BOND) ACT 222-2001:  Authorizing the issuance of $896,000 in bonds to finance the purchase of approximately 18,500 square feet of property located at 24 South Kensico Avenue in the City of White Plains and convey the property for the purpose of providing affordable housing.

 

The following Act was laid “OVER” under the rules by Mr. Noto.


COMMITTEE ON BUDGET AND APPROPRIATIONS:  Lawsuit Settlement:  ACT 223-2001:  Authorizing the County Attorney to settle the lawsuit entitled Bernice Tucker v. Westchester County Department of Correction and Rocco Pozzi, sued in his individual capacity.

 

The following Act was laid “OVER” under the rules by Mr. Mosiello.


COMMITTEE ON BUDGET AND APPROPRIATIONS AND COMMITTEE ON COUNTY OFFICERS AND DEPARTMENTS:  Benefits for County Employees called to Active Duty:  ACT 224-2001:  Providing for certain salary and benefits protection for County officers and employees who are members of the Ready Reserve and who are, or who may be, ordered to active military duty.

 

Mr. Wishnie presented the following report and act and moved that the report be received, filed and approved and the act adopted, which motion was carried by the following vote:

COMMITTEE ON LEGISLATION AND COMMITTEE ON HOUSING:  Affordable Housing Plan Statement of Need Amendment:  RES 156-2001:  Authorizing the County to amend Section V, Item C of the Westchester County Affordable Housing Plan, Statement of Need, dated June 4, 1992, to reflect the need for affordable assisted/assistive senior housing in Westchester.

 

Mrs. Bronz presented the following resolution and moved its adoption, which was declared adopted.


COMMITTEE ON COUNTY OFFICERS AND DEPARTMENTS:  Refuse Disposal District No. 1 Advisory Board:  RES 248-2001:  Confirming the appointment of John Liszewski as a member of the County Refuse Disposal District No. 1 Advisory Board.

 

Mrs. LaMotte presented the following resolution and moved its adoption, which was declared adopted.


COMMITTEE ON COUNTY OFFICERS AND DEPARTMENTS:  Taxi and Limousine Commission Reappointment:  RES 249-2001:  Confirming the reappointment of Douglas E. Thornton III as a member of the Taxi and Limousine Commission.

 

Mrs. LaMotte presented the following resolution and moved its adoption, which was declared adopted.


COMMITTEE ON COUNTY OFFICERS AND DEPARTMENTS:  Taxi and Limousine Commission Reappointment:  RES 250-2001:  Confirming the reappointment of Michael Breen as a member of the Taxi and Limousine Commission.

 

Mrs. LaMotte presented the following resolution and moved its adoption, which was declared adopted.


COMMITTEE ON COUNTY OFFICERS AND DEPARTMENTS:  Youth Board Reappointment:  RES 251-2001:  Confirming the reappointment of Clarence A. Lander as a member of the Youth Board.

 

Mrs. LaMotte presented the following resolution and moved its adoption, which was declared adopted.


COMMITTEE ON RULES:  Office Assistant Appointment:  RES 252-2001:  Appointing Susan Mauro to the position of Office Assistant (Board of Legislators).

 

Mr. Noto presented the following resolution and moved its adoption, which was declared adopted.


Motion – Adjournment:  12th District (Mr. Abinanti):  Move that when the Board adjourns it adjourns to meet on October 29, 2001 at 7:00 P.M. – Carried.
