The County Board of Legislators met in Special Session.
The Honorable George Latimer in the Chair.
The Chairman opened the meeting with a prayer and salute to our flag.
The roll call resulted as follows:

ACT 245-2000: COMMITTEE ON BUDGET AND APPROPRIATIONS: Adoption of the County Budget: Adopting the Westchester County Budget and making appropriations for the conduct of County government for the year 2001.
Mr. Wishnie presented Act 245-2000.

Legislator Carsky moved to amend the Committee on Budget and Appropriations Report Concerning the 2001 County Budget by changing the following sentence:

The motion was unanimously accepted.
1. A motion was made by Legislator Swanson, seconded by Legislator Spreckman, to delete from the Additions to the Budget from the Health Department - 270000, Line 3600 - $30,000.
A motion was made by Legislator Abinanti, seconded by Legislator Stewart-Cousins, to Table the previous motion. This motion was carried by a vote of 9-8 with Legislators Noto, Carsky, LaMotte, Maisano, Mosiello, Oros, Spreckman and Swanson voting in the negative.
2. A motion was made by Legislator Swanson, seconded by Legislator Noto, to delete from the Additions to the Budget from the Health Department 270000 from the Annual Regular Account (1010) $95,685 for (4) Sanitarian positions - Grade X and (2) Clerk/Typist - Grade VI, and benefits (521650) in the amount of $28,705.
A motion was made by Legislator Abinanti, seconded by Legislator Young, to Table the previous motion. This motion was carried by a vote of 9-8 with Legislators Noto, Carsky, LaMotte, Maisano, Mosiello, Oros, Spreckman and Swanson voting in the negative.
3. A motion was made by Legislator Swanson, seconded by Legislator Oros, to delete from the Budget from the Department of Information Technology 160000 from the Overtime Account (1400) in the amount of $100,000.
A motion was made by Legislator Pinto, seconded by Legislator Bronz, to Table the previous motion. This motion was carried by a vote of 9-8 with Legislators Noto, Carsky, LaMotte, Maisano, Mosiello, Oros, Spreckman and Swanson voting in the negative.
4. A motion was made by Legislator Swanson, seconded by Legislator Oros, to delete from the Budget from the Law Department 180000, Line 1200 (Hourly) in the amount of $10,000.
A motion was made by Legislator Pinto, seconded by Legislator Stewart-Cousins, to Table the previous motion. This motion was carried by a vote of 9-8 with Legislators Noto, Carsky, LaMotte, Maisano, Mosiello, Oros, Spreckman and Swanson voting in the negative.
5. A motion was made by Legislator Swanson, seconded by Legislator LaMotte, to delete from the Budget from the Department of Parks, Recreation and Conservation - 420000, Line (3700) (Postage) in the amount of $30,000.
A motion was made by Legislator Stewart-Cousins, seconded by Legislator Bronz, to Table the previous motion. This motion was carried by a vote of 9-8 with Legislators Noto, Carsky, LaMotte, Maisano, Mosiello, Oros, Spreckman and Swanson voting in the negative.
6. A motion was made by Legislator Swanson, seconded by Legislator Oros, to delete from the Budget (Miscellaneous) 52/53/54, Lines 2015 and 2016 (Hudson River Museum) in the amount of $30,000.
A motion was made by Legislator Stewart-Cousins, seconded by Legislator Pinto, to Table the previous motion. This motion was carried by a vote of 9-8 with Legislators Noto, Carsky, LaMotte, Maisano, Mosiello, Oros, Spreckman and Swanson voting in the negative.
7. A motion was made by Legislator Noto, seconded by Legislator LaMotte, to delete from the Additions from the Health Department 270000, Line 4380 (Indian Point Dental Research - Contractual Services) in the amount of $50,000.
A motion was made by Legislator Young, seconded by Legislator Stewart-Cousins, to Table the previous motion. This motion was carried by a vote of 9-8 with Legislators Noto, Carsky, LaMotte, Maisano, Mosiello, Oros, Spreckman and Swanson voting in the negative.
8. A motion was made by Legislator Abinanti, seconded by Legislator Young, to remove from the Table Mrs. Swanson's motion to delete from the Additions to the Budget from the Health Department - 270000, Line 3600 - $30,000.
The motion was approved unanimously.
A motion was made by Legislator Kaplowitz, seconded by Legislator Pinto, to reduce the amount of the deletion from $30,000 to $15,000.
This motion was approved by a vote of 9-8 with Legislators Noto, Carsky, LaMotte, Maisano, Mosiello, Oros, Spreckman and Swanson voting in the negative.
A motion was made by Legislator Oros, seconded by Legislator Swanson to amend Mr. Kaplowitz's proposed deletion of $15,000 back to the original $30,000.
This motion was withdrawn by Mr. Oros.
Mr. Kaplowitz withdrew his motion and Mr. Pinto rescinded his second to reduce the amount of the deletion from $30,000 to $15,000.
Mr. Latimer presented the original motion to delete from the Additions to the Budget from the Health Department - 270000, Line 3600 - $30,000. This motion was defeated by a vote of 8-9 with Legislators Noto, Carsky, LaMotte, Maisano, Mosiello, Oros, Spreckman and Swanson voting in the affirmative.

11. A motion was made by Legislator Wishnie, seconded by Legislator Bronz, to remove from the Table Mrs. Swanson's motion to delete from the Budget from the Department of Parks, Recreation and Conservation - 420000, Line (3700) (Postage) in the amount of $30,000.
The motion was approved unanimously.

12. A motion was made by Legislator Young, seconded by Legislator Stewart-Cousins, to remove from the Table Mrs. Swanson's motion to delete from the Budget (Miscellaneous) 52/53/54, Lines 2015 and 2016 (Hudson River Museum) in the amount of $30,000.
The motion was approved unanimously.
Mr. Latimer presented the original motion to delete from the Budget (Miscellaneous) 525354, Lines 2015 and 2016 (Hudson River Museum) in the amount of $30,000. The motion was defeated by a vote of 5-12 with Legislators Noto, LaMotte, Maisano, Oros, and Swanson voting in the affirmative.
13. A motion was made by Legislator Pinto, seconded by Legislator Wishnie, to remove from the Table Mr. Noto's motion to delete from the Additions from the Health Department 270000, Line 4380 (Indian Point Dental Research - Contractual Services) in the amount of $50,000.
The motion was approved unanimously.
Mr. Noto withdrew his motion to delete from the Additions from the Health Department 270000, Line 4380 (Indian Point Dental Research - Contractual Services) in the amount of $50,000.
A motion was made by Legislator Maisano, seconded by Legislator Abinanti, to delete from the Additions from the Health Department 270000, Line 4380 (Indian Point Dental Research - Contractual Services) in the amount of $25,000.
The motion was approved by a vote 13-4 with Legislators Noto, Carsky, Oros and Spreckman voting in the negative.
A motion was made by Legislator Mosiello, seconded by Legislator LaMotte, to delete from the Additions from the Health Department 270000, Line 4380 (Indian Point Dental Research - Contractual Services) an additional amount of $25,000.
The motion was defeated by a vote of 6-11 with Legislators Noto, Carsky, LaMotte, Mosiello, Oros, and Spreckman voting in the affirmative.
Mr. Wishnie again presented the act as amended and moved that the report be received, filed and approved, and the act adopted, which motion was carried by the following vote:
AYE: Legislators: Abinanti, Noto, Bronz, Carsky, Kaplowitz, LaMotte, Maisano, Mosiello, Oros, Pinto, Ryan, Spreckman, Stewart-Cousins, Swanson, Wishnie, Young, Chairman-17.
NAY: NONE.
Mr. Wishnie, seconded by Mr. Kaplowitz, made a motion to reconsider the vote just take on Act 245-2000 (As Amended) in the hope that it be Defeated, which motion was Defeated 17-0.
ACT 246-2000(AS AMENDED) COMMITTEE ON BUDGET AND APPROPRIATIONS: Levying the County and Special District Taxes: An Act fixing and determining the amounts of the County and Special District Taxes for 2001 and levying such amounts upon the real property liable therefor.
Mr. Wishnie presented the following report and act and moved that the report be received, filed and approved and the Act adopted, which motion was carried by the following vote:
AYE: Legislators: Abinanti, Noto, Bronz, Carsky, Kaplowitz, LaMotte, Maisano, Mosiello, Oros, Pinto, Ryan, Spreckman, Stewart-Cousins, Swanson, Wishnie, Young, Chairman-17.
NAY: NONE.
Mr. Wishnie, seconded by Mr. Kaplowitz, made a motion to reconsider the vote just taken on Act 246-2000 (As Amended) in the hope that it be Defeated, which motion was defeated 17-0.
